CuaderesMediations is a mediation service offered by Eduardo F. "Jim" Cuaderes, an attorney practicing in Dallas, Texas since 1990. In my years of practice, I have litigated and arbitrated hundreds of cases, many of which eventually settled at mediation. For the cases that did not settle, I successfully (and not so successfully) litigated them through motion practice, trial, and appeal. WHAT IS MEDIATION?
Black’s Law Dictionary defines mediation as an “intervention; interposition; the act of a third person in intermediating between two contending parties with a view to persuading them to adjust or settle their dispute. Black’s defines the term “mediator” as “one who interposes between parties at variance for purpose of reconciling them.”
How boring and non-descriptive are these definitions? While they are technically correct, mediation is much, much more. Mediation is an occasion for two or more opposing parties to get together with the help of a mediator so that the parties can work out their own solution to their dispute. Because what happens if the parties can’t work out a solution among themselves? A judge, an arbitrator, or a jury will impose a solution that perhaps neither party will be happy with. So mediation is more than an “intervention” or “interposition.” It’s an opportunity! It’s a choice! It is your opportunity to settle a dispute on your terms and in a way that ultimately satisfies everyone.
A mediator does much more than reconcile parties. A mediator actively listens to the participants and probes the details of the parties’ grievances and positions. A mediator is smart and suggests solutions that the parties may not have considered because they're caught up in the fog of advocacy. A mediator is a practical and neutral person that helps the parties formulate a mutual solution. For mediation to be successful, the parties have to agree on their own solution, and a good mediator will lead the parties to that solution.
Welcome to my website. I am Jim Cuaderes, and I am a mediator in Dallas, Texas. I have practiced law in Dallas since 1990. I have been on both sides of the docket representing plaintiffs and defendants in employment and personal injury cases the majority of my career. I have had my share of trial wins and losses. Believe me, when my clients lost at trial, inevitably I would look back and wish we could have settled at mediation.
I recently left the world of litigation so that I could change the focus of my career to help others solve their disputes by way of mediation.
