SERVICES AND FEES
CuaderesMediations offers mediation and arbitration services for all cases, with the exception of family cases. My past experience is mainly employment law and non-subscriber cases, which makes me exceptionally qualified to mediate employment and personal injury cases. But my variety of legal experience qualifies me to mediate any civil case other than family law matters. I am also available to arbitrate your case if your prefer to resolve your dispute via arbitration. I pledge absolute neutrality and will faithfully follow the parties' intentions embodied in the arbitration agreement.
I will give your case my undivided attention during the mediation session and will continue to doggedly work with the parties to resolve the case after the mediation.
MEDIATION SESSIONS AND TIMES
CuaderesMediations is time flexible. Most cases can be settled with a full day mediation (8 hours). I will work with the parties into the evening and night if necessary. A multi-day mediation may be appropriate for more complicated cases. A full day mediation will generally start at 9:30 a.m. and end at 5:30 p.m., but start and stop times are flexible. Half day and less than half day mediations are available in time increments of 4 or 3 hours. Half day mediations will normally start at 9:00 a.m. for morning sessions, and 1:30 p.m. for afternoon sessions. A mediation session less than three hours is discouraged. My calendar and clock are flexible and I will work with the parties to schedule a time and duration that is convenient for everyone.
FEES AND PAYMENT
Mediation fees are normally split evenly between the parties, unless the parties agree otherwise. A court may award a party's mediation expense as a taxable cost. Full payment of fees is expected before the start of the mediation session. The parties' attorneys are responsible for payment of fees. My fee for a two-party, full day (8 hour) session is $2,880 ($1,440 per party). My fee for a two-party, half day (4 hour) session is $1,440 ($720 per party). My fee for a two-party 3 hour session is $1,080 ($540 per party). An overtime rate of $360 per hour may apply for all sessions that exceed the time limits for that session. For a mediation that involves three or more parties with conflicting interests, a fee arrangement can be negotiated so that the parties can split fees pursuant to their agreement. In such a case, the fee charged will not exceed $360 per hour.
